Subject: Please support the legal challenge to TPPA Secrecy
Date: August 22nd 2015
A ‘Give-A-Little’ page http://givealittle.co.nz/cause/tppnosecrecy has been set up for for donations to support a legal challenge to the secrecy of the Trans-Pacific Partnership Agreement (TPPA) negotiations, which was filed in the High Court in Wellington on 5 August 2015.
The case involves the refusal by Trade Minister Tim Groser to release any of the documents relating to the TPPA negotiations sought under the Official Information Act by University of Auckland law professor Jane Kelsey.
The applicants in the case are Consumer NZ, Ngati Kahungunu, Oxfam, Greenpeace, Association of Salaried Medical Specialists, New Zealand Nurses Organisation, the Tertiary Education Union, and Professor Kelsey.
We believe there is an important public interest in the information being publicly available, so people can better understand the issues under negotiation and the position the government has taken on behalf of the people of New Zealand, before the negotiations are concluded.
The Official Information Act request was made in January this year, based on a report from the European Union Ombudsman recommending release of similar documents from the US-EU negotiations on the Transatlantic Trade and Investment Partnership.
The judicial review proceedings could not be lodged until the Chief Ombudsman had reviewed the Minister’s decision, which was not completed until late July.
The High Court has been asked for declarations that the Minister’s decision was unlawful in a variety of ways, and to hold an urgent hearing as soon as practicable.
Such an application incurs costs, including legal fees, filing fees and potential appeals.
We are seeking your support in this important legal challenge, whose significance extends far beyond the TPPA negotiations.
